RVMA Central Law represents CEL in a complex ICC international Arbitration Process
Rusconi Valdez Medina & Asociados Central Law represented recently the Comision Ejecutiva Hidroelectrica del Rio Lempa “CEL”, in an international arbitration process before the International Chamber of Commerce based in Paris, France.
The case, initiated by Alstom Hydro Energia Brasil Ltd, demanded the deployment of multiple resources available in the firm in light of its leading practice in the Electricity and Constructions sectors.
CEL is a public Salvadoran entity in charge of managing the hydro generation of electricity in El Salvador, and as such is subject to multiple government regulations that had to be reconciled or interpreted along the lines of “lex mercatori”, the predominant set of rules applicable in international commercial disputes, specially those presented before the ICC.
Partner Luis Medina was the leading lawyer in this case in light of his well-known expertise in the Electricity and Construction fields. About this case, he recently commented: “The nature of the client made this ICC process much more complex than a regular commercial arbitration; however after negotiations we were able to reach a settlement that what satisfactory to all the parties involved.”
Piero Rusconi, expert lawyer in litigation matters within the firm, and member of the team defending CEL in this case, considered this to be a “interesting case that allowed our firm to study how public institutions should draft its arbitration clauses in contracts”.
